EXTERNAL MEMBER ON INTERNAL COMMITTEE OR POSH COMMITTEE

In order to prevent bias or prejudice against any party, it is necessary to include a non-employee in the IC so that they can serve as a neutral, expert member of the ICC.

A person who does not belong to the organization and who must be empaneled in the ICC is referred to as an external member under the POSH Act.

The Act establishes the following eligibility requirements for an external member:

The member must be from an NGO or other social organization dedicated to the cause of women and have experience handling sexual harassment claims.


OR


A person with legal experience who is knowledgeable and skilled in issues related to sexual harassment of women can serve as the external member.

According to current trends, the majority of organisations seek out women who:

 a) Are legal experts and are knowledgeable about POSH law, Civil and Criminal laws that prevail in country.

b) Is knowledgeable, skilled, and able to handle complaints of sexual harassment in a professional manner. Some one with a HR background.

c) Possesses a thorough understanding of the legal ramifications and aspects of sexual harassment.
